How to Register a Business

how to register a business nameThe term “branding” has come into vogue in recent years and can refer to anything from an individual to a business. The naming of a product is one aspect of branding, and indeed one of the more important choices a business owner will make. A College Station business attorney can help you with all steps in setting up a new company, including coming up with an appropriate name.

Coming up with a Name

Registering the name of a business in this state is rather a simple matter. The choosing of a catchy name that is memorable and distinct is most likely the most difficult part. You need to be careful not to use a name that too closely resembles an already recognized company, for you could face a lawsuit.

It is actually a good idea to come up with several names, as will be seen. Try to keep it to no more than a few words. Notice that the world's most recognized names are generally quite concise. In fact, Kentucky Fried Chicken is now universally known as KFC. You can even select something witty. One bookstore in Georgia chose the name “Chapter 13.”

Registering the Name

You will then need to register the name with the local county clerk's office. It is a good idea to call ahead for the best time so that you can avoid waiting in a long line. As mentioned, you should have several names selected. This is just in case your first choice has already been taken. Give the first name to the clerk, and he will run a name search to determine if another company has taken the name. If so, choose your second name.

Sometimes a name that was used previously has been abandoned, often because the business fails. If you decide to take this name, you will want to run an Internet search on it to find out whether there are any negative comments written about the business, or if it had a poor reputation. You don't want your business associated thusly.

Once you select the name you simply fill out a form and pay a fee. This fee will need to be paid every ten years. You will also need to file a form SS4 with the IRS to obtain an Employer Identification Number, or EIN.
