Probating a Will in Texas

The initial shock of losing a loved one can be crippling, but those closest to the departed soon realize there are many questions to answer and decisions to be made. Did the deceased have a burial plan?  Did he or she purchase a cemetery plot or other plan?  Who should you call, and when should you have the funeral or memorial service?

On top of the important decisions regarding final arrangements, those closest to the departed will ask or be asked whether their loved one left a will.  Hopefully the answer is yes and the will can be easily located.  People commonly leave wills in files at home or with a trusted attorney.  In Texas, a person may have filed a will with the County Clerk.

Once a loved one's will has been found, the heirs must determine whether the person named as the executor in the will is willing and able to perform the duties of an executor.   The next course of action for the executor and each heir is to contact an experienced estate planning attorney, even if all that is needed is a consultation to explain the probate process and answer questions.
