Ditch the Prenup and Consider a Trust Instead

Let's face it.  No one wants to talk about prenuptial agreements.  Just bringing up the issue with a potential fiancé can negate the need for one altogether.  Considering the possibility of divorce when considering the possibility of marriage is a touchy subject often beyond the limits of political correctness and definitely outside the realm of romance.

On the other hand, pragmatic adults recognize the fact that more than half of all marriages in the U.S. end in divorce.  If you have significant assets to protect, then a prenuptial agreement may seem like a reasonable request.  Thankfully, you may not have to bring the issue up at all, because there is another option.

If the reason you are interested in a prenuptial agreement is to protect assets, a foreign or domestic asset protection trust may serve the same purpose and is a whole lot easier to accomplish from a relationship perspective.

Since you don't need anyone's permission or agreement to set up an asset protection trust, you can stop waiting for the right moment to bring up the prenuptial agreement.  Instead, make an appointment with an experienced estate planning attorney to discuss your situation and consider alternatives to meet your goals.

At Peterson Law Group, we have significant experience in family law, estate planning, and business law issues, and can use our experience to help you achieve the best outcome possible.  To schedule a consultation, call us today at 979-703-7014 or 936-337-4681.
