A College Station Child Custody Lawyer Discusses Visitation Scheduling

College Station Child Custody Lawyer As the non-custodial parent of your child, you have a right to a routine, court-ordered visitation schedule that allows you an appropriate amount of quality parenting time. In many custody cases, the visitation schedule becomes the most contentious centerpiece to the litigation. However, the lawyers of the Peterson Law Group understand the benefits to a calm and collaborative approach to visitation planning and will help effectuate a workable solution for you and your child's other parent.

If you wish to set up a visitation schedule or would like to petition the court to modify a current standing visitation order, a College Station child custody lawyer can help you through the process.

Standard Visitation Scheduling

The Texas Code contains a section dealing with standard visitation orders. It states that parties are otherwise permitted to mutually agree upon visitation and, in the event this is not possible, should refer to the standard guidelines contained within their particular order. There are also standard guidelines in the Code for parents residing greater than 100 miles apart.

For parents residing 100 miles or less from one another, the non-custodial parent (referred to in the Code as the “possessory conservator”) shall enjoy visitation with the child on weekends beginning at 6 p.m. on the first, third, and fifth Friday of each month and ending at 6 p.m. on the following Sunday. As well, the court will likely order visitation on Thursdays of each week during the regular school term beginning at 6 p.m. and ending at 8 p.m. The standard visitation schedule also provides for alternating holidays, birthdays and Mother's/Father's Day. If you believe this schedule would be detrimental to the children in light of their age, developmental status, special circumstances or needs, you can petition the court for an alternative schedule.
