Texas maintains a settlement option known as the judicial settlement conference that has proven helpful in allowing parties to present their position on a certain matter before a neutral, third-party mediator thereby effectuating possible compromise.

Your Bryan family law attorney will tell you that achieving compromise through the judicial settlement conference not only eliminates the expenses of a full trial on the issues, but allows the parties to maintain some control over the outcome as opposed to submitting the entire case to a judge for decision.

The Settlement Conference Procedure Your divorce lawyer will prepare you by explaining that the judicial settlement conference is informal in nature and may be conducted with or without the presence of your attorney (although we always encourage our clients to negotiate with their attorney present).

During the negotiation, you will discuss any and all divorce issues that are a source of contention for you and your spouse. This could include property division, custody or visitation issues. Parties may not limit child support payments, but may agree to additional support in excess of that required by law. As well, the results of the settlement conference are considering binding on the parties only if:

  • The settlement agreement states, in a prominently displayed statement that is in boldfaced type or in capital letters or underlined, that the agreement is not subject to revocation;
  • Both parties have signed the agreement, and;
  • Both your attorney and your spouse's attorney have signed the settlement agreement.
