Why a prenuptial agreement?

For many people preparing to wed, signing a prenuptial agreement is a wise decision. A prenuptial agreement is especially important for individuals who are marrying after they have accumulated a significant amount of wealth and/or have children from a previous marriage. The risks associated with bringing these responsibilities into a marriage without protecting them are simply too great to ignore. With that said, a prenuptial agreement is essentially a contract that details how assets will be distributed should a divorce or untimely death occur. It allows assets that would normally be considered community property to be declared and distributed as separate property. For some, this distinction could be worth hundreds of thousands, if not millions, of dollars and carry important weight in the estate planning process. This is especially true in scenarios where one party has children from a previous marriage and they wish to leave a sizeable amount of their estate to those children instead of, or in addition to, their new spouse.
